“Digital Ninja" Ltd. operates a blog, an online shop and an online community on its WEBSITE and offers information, PRODUCTS and SERVICES of various kinds there.

 

The WEBSITE is informational in nature and is operated and maintained by “Digital Ninja" Ltd.

​TERM DEFINITIONS

In these GENERAL TERMS AND CONDITIONS, the terms listed below have the following meanings

 

"DN" hereinafter stands for "Digital Ninja" Ltd., with registered company number / UIC: 207308629. Detailed information about "Digital Ninja" Ltd. and contact details can be found in Section 1.

 

“TOS” means these GENERAL TERMS AND CONDITIONS and their appendices, as well as any subsequent amendments, published and accessible on the WEBSITE.

 

DN offers a member area for registered MEMBERS and includes, among other things, discussion forums, public and private groups and user profiles that are visible to all MEMBERS, which are necessary to be able to participate in the online community in various ways. Possible forms of participation are the creation of texts and articles, participation in public or private group discussions, sending messages in groups or to other members, searching for specific members or topics in groups, forums or blog articles and other various interactions with other MEMBERS. MEMBERS must actively register and actively confirm that they are aware of and comply with the terms and conditions and the community guidelines (LINK).

 

"ORDER" means an ORDER placed by a USER through the WEBSITE for the purchase of the PRODUCTS or SERVICES specified by the USER, together with indication of the chosen payment method and acceptance of the T&Cs and SPECIAL TERMS of the ORDER, if any. In the case of PRODUCTS, in addition to the USER's address, the ORDER also contains the address for DELIVERY or collection of the PRODUCTS in question. SERVICES are ORDERED by ORDERING a corresponding range of services on the WEBSITE. In the case of SERVICES, after the ORDER has been placed, the USER will have access to the purchased services, which will be provided under the conditions and GTC / SPECIAL CONDITIONS indicated on the WEBSITE and within the period indicated on the WEBSITE.

 

"USER" means any person using the WEBSITE in any way, including but not limited to browsing, creating their own PROFILE by registering, acting as a MEMBER within the online community, placing ORDERS and doing anything else with it related actions.

 

“MEMBERS” are USERS who, in addition to REGISTRATION and placing ORDERS on the WEBSITE, actively participate at their own request. This includes creating and posting texts or articles, actively participating in forums and groups, uploading articles or other files, and all kinds of interactions with other MEMBERS.

 

"USER PROFILE" means that part of the WEBSITE identified by an electronic address (e-mail), a username (optional) and a password where applicable, which allows the USER or MEMBER to place ORDERS or to become active as a MEMBER. For USERS, the USER PROFILE contains all the information about the USER that the USER provided when registering through the WEBSITE, as well as the USER's order history. "PRODUCTS" means all goods, including accessories, materials, etc., offered for sale directly or indirectly by "DN" from time to time through the WEBSITE and which form part of "DN"'s articles published on the WEBSITE.

 

“SERVICES” means all service offerings offered by DN through the WEBSITE, including but not limited to coaching, consulting, online courses, etc. These SERVICES are prepared or rendered as offered by qualified professionals and experts and may vary by type of the Service have different characteristics and characteristics that are detailed on the WEBSITE.

 

"SERVICES" means all SERVICES offered to USERS and made available by "DN" through the WEBSITE at any given time, including all use, sale and DELIVERY of PRODUCTS and SERVICES.

 

"USE" of SERVICES means that a purchased service is used by the USER under the terms and conditions specified on the WEBSITE and within the specified period of time and is therefore usually consumed.

“DELIVERY” means the packing and shipping of PRODUCTS in accordance with the Ordering and Shipping Conditions.

GENERAL

​The GTC are binding for all persons who register via the WEBSITE and place ORDERS or who register as a MEMBER and are active.

 

In order to be able to place an ORDER or to register as a MEMBER, the USER / MEBMBER must enter their data on the WEBSITE, such as e-mail address, telephone number, shipping address and electronic address (e-mail). This is done in accordance with applicable data protection law and our privacy policy (LINK)

 

The T&Cs apply to all ORDERS placed through the WEBSITE. In the event of a conflict between the GTC and the SPECIAL TERMS of the ORDER, the SPECIAL TERMS of the ORDER shall prevail.

 

The GTC may be modified by "DN" from time to time with a view to the regular completion and modification of the various SERVICES, their improvement and expansion, as well as in connection with possible legislative changes that affect them. Changes to the GTC come into effect on the date of their publication on the WEBSITE. USERS who do not agree with the changes to the GTC have the right to delete their USER PROFILE and stop using any SERVICES. REGISTRATION & AGREEMENT TO THE TERMS AND CONDITIONS

In order to register their USER PROFILE, the USER must fill out a registration form accessible through the WEBSITE, following the instructions. When registering, the USER must provide an electronic address as a user ID (email address), a telephone number and a password to access their USER PROFILE.

 

By registering on the WEBSITE, the USER / MEMBER accepts these GTC and undertakes to comply with them.

 

After registration, to ORDER PRODUCTS or SERVICES through the WEBSITE, the USER can use the following means of electronic identification: user ID (alternatively email address) and password, which are set by the USER when filling in the registration form or by the system at the request of the USER be generated automatically. The same applies to the use of the NVC / MEMBER area.

 

By registering, the USER / MEMBER assures that he is an adult natural person and that he is using his true identity and registration data.

 

The USER / MEMBER represents and warrants that when filling out the registration form on the WEBSITE, they will provide true and complete information. In the event that the circumstances specified during the initial registration change, the USER undertakes to update the relevant data in his USER PROFILE no later than the time of the next ORDER after the changes have occurred.

 

The USER / MEMBER is solely responsible for maintaining the confidentiality of his user ID and password, which he uses to identify himself for the use of the WEBSITE, as well as for the actions of third parties with this data. Upon suspicion of unauthorized or unauthorized access, stolen or lost user ID and/or password, the USER must immediately notify "DN" in order to block access to the personal data of the USER and to prevent unauthorized actions with the USER PROFILE. The USER is solely responsible for any damage caused to him, "DN" or third parties as a result of the unauthorized use of his user ID and password.

​ORDERS

​Binding ORDERS can only be placed via the WEBSITE.

 

The USER has the option of choosing from the full range of PRODUCTS and SERVICES categories available on the WEBSITE. “DN” has the right to make changes to the PRODUCTS & SERVICES, their prices and other terms relating to DELIVERY or USE. USERS are deemed to be aware of these changes from the date of their publication on the WEBSITE.

 

The USER can place ORDERS through the WEBSITE by selecting the desired PRODUCTS or SERVICES and following the following basic technical steps to complete and ship the corresponding ORDER:

Login to the USER PROFILE.

If the "Shipping" option is selected, the USER must provide and confirm a new shipping address.

 

Place the PRODUCT(s) and SERVICE(s) in the virtual shopping cart.

 

Until the ORDER is completed, the USER can view and modify the PRODUCTS or SERVICES ordered, the quantities and other data related to the specific ORDER.

 

By clicking on the "Complete ORDER with costs" button, the USER completes the ORDER and agrees to purchase the PRODUCTS contained in his virtual shopping cart under the terms of these GTC.

 

The ORDERS, as well as the contact details of USERS ordering for the first time, can be confirmed by telephone. For this reason, the USER should provide a telephone number in his ORDER where he can receive a confirmation.

PRICES, PAYMENT METHODS AND PROMOTIONS

The prices of the PRODUCTS & SERVICES are listed on the WEBSITE on the sub-pages for the respective PRODUCTS & SERVICES specified.

 

The DN has the right to use the offered PRODUCTS & SERVICES subject to change at its sole discretion, at any time and without prior notice. The USER is considered to be aware of these changes from the date of their publication on the WEBSITE. The USER is obliged to pay the price for the offered PRODUCTS & SERVICES that was indicated on the WEBSITE at the time of the ORDER, whether lower or higher than a subsequently adjusted price.

 

The USER can pay the price of the PRODUCTS under an ORDER in one of the following ways:

• payment with credit card

• Payment via Paypal

• Cash on pickup

• Payment by invoice (only possible under certain conditions)

 

​The USER can find detailed information about promotions on the WEBSITE. Each promotion is independent and cannot be used in conjunction with any other promotion or offer.

 

DN reserves the right, at its sole discretion, to make promotional offers by email or through the USER PROFILE, depending on how the USER uses the WEBSITE.

The USER can object to the receipt of ADVERTISING EMAILS without affecting other USER / MEMBER options.

LIABILITY

​The content of the WEBSITE is provided "as is" without any warranty of any kind, express or implied, and disclaims all other warranties, including but not limited to: availability, accuracy, reliability, timeliness, completeness, implied warranties or Conditions of merchantability, fitness for a particular purpose, non-infringement of intellectual property or other related rights. Except for the above, “DN” makes no warranties or representations as to the accuracy, likely results, or reliability of using similar PRODUCTS or SERVICES for any other purpose

The WEBSITE only works as long as there is an internet connection on the device used.

 

DN selects partner sites or all linked sites to the best of its knowledge and with care. However, DN cannot continuously monitor the content of third-party sites and their sub-sites to which links (links) are offered from the WEBSITE and is not responsible for the content of linked third-party sites or links from portals. The inclusion of a link in the content of the WEBSITE does not imply any obligation on the part of DN. Use of any such linked site is at the USER's own risk.

 

DN shall not be held responsible for the impossibility of registering through the WEBSITE or in the event that access to any part of the WEBSITE is unavailable at any given time or the quality of access is impaired for any reason. DN shall not be liable for any damage to telecommunications equipment, software and hardware, or loss of data resulting from any materials or resources used in any way through the WEBSITE.

 

The DN shall not be liable for the purposes and activities of the USER in connection with the use of the WEBSITE, nor for the content of the USER PROFILE of the USER.

 

DN has the right to refuse to execute an ORDER or to create a USER PROFILE of any USER who, by his actions or omissions, has given DN reasonable cause to believe that he cannot in good faith perform his obligations under these GTC or violates the violated the guidelines associated with the Terms and Conditions.

The content and information published on the WEBSITE may contain technical, typographical or photographic errors. The DN may make changes to the content contained on the WEBSITE at any time and without prior notice, but does not undertake to update it in general.

The provisions of the legislation in force in the Republic of Bulgaria apply to matters not regulated in these GTC.

 

All intellectual property rights such as trademarks and copyrights to materials, photos, logos, images and the like published on the WEBSITE remain the property of “DN”. Any use of the WEBSITE or its contents, including copying or storing such contents in whole or in part, except for the personal, non-commercial use of the USER is prohibited. Violators will be prosecuted in accordance with the provisions of the Copyright and Related Rights Protection Act and the Trademarks and Geographical Indications Act. DN reserves the right to suspend, temporarily or permanently, the provision of part or all of the SERVICES available through the Website.

 

The DN has the right to fully terminate and delete the USER's registration if:

• the user provides false or incomplete information.

• the DN suspects abuse, misconduct or violation of these Terms and Conditions by the user.

• the User provides an incorrect delivery address and/or unreasonably refuses delivery of the Products ordered by the User.

• force majeure or other objective reasons, including but not limited to the existence of an order from the relevant governmental authorities to suspend the provision of some or all of the Services available through the Website.

• the DN will stop maintaining the website.

 

 The USER has the right, at any time and at their own discretion, to stop using the services made available by DN by deactivating their profile. The profile can be deactivated or completely deleted by DN at the USER's request.

 

The electronic statements and communications provided for in these General Conditions of Sale are considered valid if they are made in the form of emails, by pressing a virtual button on the WEBSITE and the like, provided that the statement is technically recorded in such a way that it can be reproduced .
